CVmakers is presented to you by Company Manager Australia PTY LTD. The following terms and conditions apply to the use of CVmakers. By using CVmakers, you agree to these terms.
Deviations from or additions to these terms of use are only binding if they have been accepted in writing by CVmakers.
Article 1. Use by Job Seekers
1.1. Through CVmakers, you can create, modify, download, and send resumes and cover letters for a fee.
1.2. After creating a resume, an account will be automatically created for you. Once your registration is complete and the account has been activated by CVmakers, you can log in and continue using CVmakers.
1.3. You are responsible for protecting access to your account with a username and password from unauthorized access. The password must be kept strictly confidential. CVmakers assumes that all activities carried out from your account after logging in with your username and password are under your direction and supervision. Therefore, you are liable for all these actions, unless you have reported to CVmakers that someone else knows your password.
1.4. CVmakers processes your personal data. For more information, please refer to the privacy policy of Company Manager Australia PTY LTD.
Article 2. Usage Rules
2.1. Accounts are personal and non-transferable.
2.2. It is prohibited to use CVmakers for activities that violate national or international laws and regulations. This includes, in particular, storing or distributing defamatory or racist information as well as sending unsolicited messages.
2.3. If CVmakers finds that you are violating these terms or receives a complaint about it, CVmakers may take its own measures to end the violation. In the event of a violation of the provisions of 2.1, the account will be closed and deleted.
2.4. If CVmakers detects a threat to the functioning of CVmakers' or third-party computer systems or networks and/or services over the Internet, such as excessive email or data transmission, personal data leaks, or the activities of viruses, Trojans, and similar software, CVmakers is entitled to take all necessary measures to avert or prevent this threat.
2.5. CVmakers is entitled at any time to report criminal offenses.
2.6. CVmakers may claim damages from you for damages resulting from violations of these rules of conduct. You indemnify CVmakers against all third-party claims related to the information you provide.
2.7. You are solely responsible for all content you create and send via CVmakers, including resumes and cover letters.
Article 3. Availability and Maintenance
3.1. CVmakers strives to ensure the service is always available, but this cannot be guaranteed.
3.2. CVmakers actively maintains the system. Maintenance can take place at any time, even if it may result in limited availability. Maintenance work will be announced in advance if possible.
3.3. CVmakers reserves the right to modify the functionality of the service. Feedback and suggestions are welcome, but CVmakers ultimately decides which adjustments will be made.
Article 4. Intellectual Property
4.1. CVmakers, the resume templates, cover letters, associated software, and all information and images on the website are the intellectual property of CVmakers or its licensors. They may not be copied or used in any way without written permission from CVmakers, unless permitted by law.
4.2. Information you publish or store through CVmakers, such as texts in your resume or passport photo, remains your property (or that of your suppliers). CVmakers has a limited right to use this information for CVmakers.
4.3. You may revoke this usage right by removing the relevant information and/or terminating the contract.
4.4. You may modify the information published or stored through CVmakers at your discretion.
4.5. If you send information to CVmakers, such as bug reports or improvement suggestions, you grant CVmakers a perpetual and unrestricted right to use this information. This does not apply to information marked as confidential.
4.6. CVmakers does not access private data (such as communication between job seekers and employers) that you store and/or distribute via CVmakers unless it is necessary to provide the service or required by law. In such cases, CVmakers will strive to limit access to the data to what is necessary.
4.7. During the term of your account or order, you have the right to use CVmakers and the documents created with the service, such as resumes or cover letters. After the order is completed, you may continue to use the application letters and/or resume layouts we created. These may only be used after purchasing the corresponding rights from CVmakers.
Article 5. Fees for Job Seekers
5.1. There is no fee for downloading a created resume.
5.2. An account is required to use CVmakers.
5.3. The current prices for downloading resumes and subscription fees are available on the CVmakers website.
Article 6. Right of Withdrawal
6.1. Since the resume is provided digitally at your express request, the statutory right of withdrawal lapses.
Article 7. Payment Terms
7.1. Payment is made by direct debit, credit card, PayPal, or in accordance with the payment instructions on the website. Once payment is received by CVmakers, the order will be processed.
7.2. If CVmakers is unable to collect the owed amount and/or you do not pay on time, you are required to fully compensate the extrajudicial costs in addition to the owed amount and accrued interest.
Article 8. Duration and Termination of Subscription
8.1. The buyer begins creating their account, as mentioned in Article 1 of these terms and conditions.
8.2. As a consumer, you can cancel the account at any time through your account.
8.3. No refund of already paid amounts will be made upon termination of the account.
Article 9. Liability
9.1. To the extent permitted by Australian law, the following liability limitations apply to the use of CVmakers.
9.2. CVmakers is only liable in the case of intent or gross negligence and is limited to the amount you paid in the three months before the damage occurred.
9.3. CVmakers is not liable for indirect damages, consequential damages, lost profits, lost jobs, lost savings, or damages caused by business interruption.
9.4. In the case of force majeure, CVmakers is never obliged to compensate. Force majeure includes failures of the Internet, telecommunications infrastructure, power failures, civil unrest, mobilization, war, traffic disruptions, strikes, lockouts, business interruptions, supply shortages, fire, and floods.
Article 10. Changes to Prices and Conditions
10.1. CVmakers may change these terms and conditions and prices, to the extent permitted by law.
10.2. Changes or additions will be announced at least thirty days before they take effect on the CVmakers website.
10.3. If you do not agree with a change or addition, you can terminate the contract up to the effective date. The use of CVmakers after the effective date constitutes acceptance of the amended or supplemented conditions.
Article 11. Other Provisions
11.1. This agreement is governed by Australian law.
11.2. Unless otherwise required by law, all disputes related to the terms of use will be handled before the competent Australian court in the district where the job seeker is located.
11.3. If a provision of these terms requires a "written" notice, this also applies to emails or communication via CVmakers, provided it can be demonstrated that the notice was actually sent by the specified sender and the integrity of the message was not compromised.
11.4. CVmakers is entitled to transfer its rights and obligations under the contract as well as the personal data processed by it to a third party that takes over CVmakers or the corresponding business activity.
